You were arrested and entered into PTI or CD program
If you were arrested and charged with a crime, it may have been your first offense. If so, you may have been eligible for the Pre-Trial Intervention Program, known as PTI, conditional discharge program or conditional dismissal program. If you have successfully completed the program, an order of dismissal should be entered by the court. Now, you may want to think about having this arrest, charge and outcome removed from your criminal record so it does not show up on a background check.
When can I file an expungement petition?
If an order of dismissal was entered by the court, you are eligible for expungement 6 months after the date of the order. The court will not automatically expunge your record for you. You must take action to have this done yourself or hire an attorney to have it done for you.
How do I remove an arrest and PTI or Conditional Discharge from my criminal record?
You will need to file a petition for expungement in the county where the matter was heard. If the matter was heard in a municipal court, it should be filed in the county that municipal court is in.
