can I expunge an ordinance violation
from my criminal record in nj
NJSA 2C:52-4
You Plead guilty to an ordinance violation
There are many different types of municipal ordinances. Maybe you were charged with violating a municipal ordinance and you plead guilty to that violation. Maybe you were charged with something more serious and as part of your plea agreement, you plead guilty to a downgraded offense of a municipal ordinance violation. Whatever your situation is, the guilty plea associated with the ordinance violation will appear on your criminal record even though an ordinance is not a crime. Some people do not care if an ordinance is on their record. However, depending on which ordinance you plead guilty to, your employer or future employer may care and it could prevent you from getting your next job. You are entitled, if eligible, to have the ordinance violation expunged from your New Jersey criminal history.
When can I file an expungement petition?
If you plead guilty to a municipal ordinance violation in New Jersey, you have to wait 2 years before you can apply to have the matter expunged. The two year waiting period begins from the date of your conviction, payment of fine, satisfactory completion of probation or release from jail, whichever is later.
Am I eligible to expunge an ordinance from my record?
In order to be eligible to remove an ordinance violation from your criminal record, you must meet the following criteria:
- Must not have been convicted of a crime in any state either before or after the ordinance violation
- No more than 2 petty disorderly/disorderly persons offenses on your record
How do I remove an ordinance violation from my criminal record?
You will need to file a petition for expungement in the county where the matter was heard. If the matter was heard in a municipal court, it should be filed in the county that municipal court is in.
