You Plead guilty to a crime called a felony in New JErsey

A felony is the most serious type of crime you can have on your record in New Jersey.  It may be because you made a  stupid mistake when you were younger and now you have changed.  You have started a new life that is crime free and applied for a really good job you are hoping to get.  However, you receive a call from that company that they will not be offering you a job.  You wonder why and then realize that your background check revealed an arrest years ago and a charge that you plead guilty to.  Depending on what the charge was, employers are afraid to hire individuals with a record.  It exposes them to risk that maybe another qualified candidate will not.  

When can I file an expungement petition?

If you plead guilty to a felony or indictable offense in New Jersey, you have to wait 10 years before you can apply to have the matter expunged.  The ten year waiting period begins from the date of your conviction, payment of fine, satisfactory completion of probation or release from jail, whichever is later.  

Am I eligible to expunge a crime from my record?

In order to be eligible to remove a felony crime from your criminal record, you must meet the following criteria:
  1. Must not have been convicted of a crime in any state either before or after the crime you want to expunge
  2. No more than 2 petty disorderly/disorderly persons offenses on your record

Can I apply to have a felony expunged from my record early?

NJ law allows for indictable matters or felonies to be expunged early if certain guidelines are met.  However, it is not a guarantee that you can have it expunged early because even if you meet all of the qualifications, a judge will need to state that it is in the public interest to allow you to expunge your matter early.  This is a very high standard and is very subjective depending on which county and which judge is hearing your matter.  In determining if it is in the public interest, a judge will review the nature of the offense, your character and your conduct since you plead guilty.

How do I remove a FElony from my criminal record?

You will need to file a petition for expungement in the county where the matter was heard.
