NJSA 2C:52-6

You were arrested and no conviction

If you were arrested or held to answer for a crime, disorderly persons offense, petty disorderly persons offense or municipal ordinance violation in New Jersey and the matter was dismissed against you or you were found not guilty, you have a right to remove that arrest and charge from your criminal record.

When can I file an expungement petition?

If you were arrested and found not guilty, you can immediately file a petition for expungement.
If you were arrested and the charge was dismissed, you can immediately file a petition for expungement.

How do I remove an arrest and dismissal from my criminal record?

You will need to file a petition for expungement in the county where the matter was heard.  If the matter was heard in a municipal court, it should be filed in the county that municipal court is in.
